1. Acceptance of terms
By accessing or using the Goliath Dispatch platform or marketing site, you agree to these Terms and Conditions and to the Privacy Policy. If you are accepting on behalf of a company, you represent that you have authority to bind that company.
2. Description of service
Goliath Dispatch provides software for dispatch companies to manage carrier onboarding and compliance, load dispatch, document management, invoicing and settlements, tracking, and permit and escort tracking. We are a software provider; we are not a motor carrier, freight broker, or insurer, and do not assume the regulatory obligations of any of those roles.
3. Accounts and eligibility
You must provide accurate registration and onboarding information and keep it current. Accounts are issued to a company and its authorized users; sharing login credentials is prohibited. We may suspend or terminate an account for a material breach of these terms, non-payment, or conduct that puts other users, drivers, or the platform's integrity at risk.
4. Carrier and operator responsibilities
Carriers and dispatch companies remain solely responsible for their own regulatory compliance, including maintaining valid operating authority and insurance, obtaining and carrying every permit required for a load in every state it crosses, and arranging any required escorts. The platform's oversize evaluation is operational guidance, not a legal determination — see the Heavy Haul & Oversize page. Obtaining correct permits is always the operator's responsibility, and the platform's evaluation does not shift that responsibility to us.
5. Fees and billing
Subscription fees, dispatch fees and any other charges are as agreed in your order form or account settings, billed on the stated cycle. Fees are non-refundable except as required by law or expressly stated otherwise.
6. Prohibited uses
You may not use the platform to submit false onboarding, compliance or insurance information; to circumvent a compliance gate through means other than a documented, authorized override; to interfere with the platform's security or availability; or to use another user's or carrier's data without authorization.
7. Intellectual property
The platform, its software, and its content are owned by Goliath Dispatch or its licensors. You retain ownership of the data you submit; you grant us the license needed to host, process and display it to operate the platform for you.
8. Disclaimers
The platform is provided "as is." Compliance gates, oversize evaluations and verification results are decision-support tools based on the data provided to the platform; they do not constitute legal, regulatory, insurance or permitting advice, and do not guarantee compliance with any law, regulation, or a specific state's permit or escort requirements.
9. Limitation of liability
To the maximum extent permitted by law, Goliath Dispatch is not liable for indirect, incidental, consequential or punitive damages, or for any citation, fine, impound, delay, or cargo loss arising from a permit, escort, or regulatory compliance failure, which remains the operator's responsibility as described above. Our aggregate liability for any claim is limited to the fees you paid us in the twelve months preceding the claim.
10. Termination
Either party may terminate as provided in your order form or, absent one, with 30 days' written notice. Financial and compliance records are retained after termination as described in the Privacy Policy's retention section.
11. Dispute resolution and governing law
These terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Disputes will be resolved in the state or federal courts located in Tarrant County, Texas, and each party consents to that venue.
12. Changes to these terms
We will post any material change here with an updated "Last updated" date. Continued use of the platform after a change takes effect constitutes acceptance of the revised terms.
